Spark Terms of Service
Welcome to Spark, an app for couples built around a daily photo moment you share with your partner. These terms are the agreement between you and the people who run Spark. We've written them in plain language so you can actually read them.
Spark is operated by Nikodem Zelenak, an individual based in Slovakia, in the European Union. Throughout these terms, "we," "us," and "the operator" mean Nikodem Zelenak; "you" means you, the person using the app. You can reach us anytime at privacy@mysparks.app.
These terms cover the Spark mobile app and our website at https://www.mysparks.app. How we handle your personal data is explained separately in our Privacy Policy, which is part of your agreement with us.
1. Acceptance and eligibility
By creating an account or using Spark, you agree to these terms. If you don't agree, please don't use the app.
Spark is for people aged 16 and over. By using it, you confirm that you are at least 16. If we learn that an account belongs to someone under 16, we will delete that account and its data.
One account per person. Each person may hold a single Spark account. Spark is designed for two paired individuals, so please don't share an account, register on behalf of someone else, or create multiple accounts for yourself.
2. Your account
To use Spark you'll create an account, either with an email address and password or by signing in with Google or Apple.
- Keep your information accurate. Give us truthful account and profile information, and keep it up to date.
- Keep your credentials safe. You are responsible for protecting your login details and for what happens under your account. Don't share your password, and use the security features your device offers.
- Tell us if something's wrong. If you think someone has accessed your account without your permission, email us at privacy@mysparks.app so we can help.
3. Your content
You own what you create. The photos, captions, drawings, notes, bucket-list items, game answers, and everything else you put into Spark are yours. We don't claim ownership of your content.
To run the app for you, we need your permission to handle that content. So you grant the operator a non-exclusive, revocable license to use your content solely to operate and provide Spark — for example, to store it, to transmit it to your paired partner, and to render it back to you and your partner in the app (including previews, thumbnails, home-screen widgets, and recaps). This license exists only so the app can function; we do not use your content to advertise, to train unrelated systems, or for any purpose beyond running the service for you.
The license ends when the content does. When you delete a piece of content, or when you delete your account, the license over that content ends and we stop using it, except where we are briefly completing deletion or where the law requires us to keep something. One exception: the shared photo memories you made with your partner stay with them after you delete your account (see Section 4 and the Privacy Policy), so your license over those specific photos continues for your partner's use — it ends only when your partner deletes them or deletes their own account, or when you ask us to remove them. If you have no partner, or you're the last to leave, those photos are deleted too. Deletion is described in Section 6 and in the Privacy Policy.
You are responsible for the content you add, and you confirm you have the right to add it (see Section 5).
4. Sharing with your partner
Spark is a shared app for two people, and that is the whole point. You understand and agree that, once you pair with a partner, Spark's couple features share your content and activity with that partner.
Depending on which features you use, your paired partner can see things like your profile and relationship details, your daily photo moments and shared gallery, your game answers and scores, items and notes you mark as shared, and — only while you have location sharing (Together Map) turned on and Ghost Mode off — your location. Keep this in mind when you add something to the app.
Sharing lasts until you unpair. These couple features keep sharing with your partner until you unpair. If you unpair, sharing between you stops and the couple-only data that existed just because you were together - games, your bucket list - is deleted.
If you delete your account, your shared photos stay with your partner. Deleting your account removes your profile, logins, and the couple content tied just to the two of you — but the shared photo memories you made together stay with your partner as their own memories, with your name and details removed, because deleting your account shouldn't erase theirs. You have 30 days to undo (access is locked during that window), and you can email privacy@mysparks.app at any time to have specific photos, or all of them, removed from your partner's side. If you have no partner, or you're the last to leave, everything — including the photos — is deleted. 5. Acceptable use
Spark is a private, trusting space for two people. To keep it that way, you agree not to:
- Post unlawful content — anything illegal, or content that is threatening, abusive, hateful, or otherwise harmful.
- Harass or harm anyone, including your partner or the operator.
- Impersonate another person or misrepresent who you are.
- Add other people's personal data without their consent — don't upload someone else's photos, contact details, or private information unless you have their permission.
- Reverse engineer the app — don't decompile, disassemble, or otherwise try to extract our source code, except to the narrow extent the law expressly permits.
- Scrape or automate — don't use bots, scrapers, or other automated means to access, harvest, or interfere with Spark, and don't try to disrupt, overload, or break the security of the service.
If you break these rules, we may act under Section 6.
6. Termination
You can leave anytime. You can delete your account in the app under Settings → Delete Account. This removes your account, profile, logins, and the couple content tied just to the two of you — but the shared photo memories you made with your partner stay with them (with your name removed), unless you have no partner or are the last to leave, in which case everything, including the photos, is deleted. You have 30 days to undo before the deletion becomes permanent, and you can email privacy@mysparks.app to have specific photos, or all of them, removed from your partner's side. Deletion is described more fully in Section 4 and in the Privacy Policy. You can stop using Spark whenever you like.
We may suspend or terminate for violations. If you break these terms — for example, by misusing the app under Section 5 — we may suspend or terminate your access, remove offending content, or close your account. Where it's reasonable and lawful to do so, we'll aim to give you notice and a chance to put things right, but for serious or repeated violations, or where the law or someone's safety requires it, we may act immediately.
Some parts of these terms are meant to survive the end of your account — in particular the sections on your content license ending (Section 3), disclaimers (Section 7), limitation of liability (Section 8), and governing law (Section 9).
7. Disclaimers
Spark is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the extent the law allows.
We work hard to keep Spark running, but we cannot guarantee that the service will be uninterrupted, error-free, secure, or always available. Features may change, pause, or be discontinued, and occasional downtime, bugs, or data-sync delays can happen. Spark is a companion for your relationship, not a safety, emergency, or backup service — please don't rely on it as your only copy of anything that matters to you, or for anything time-critical or life-critical.
Nothing in this section takes away rights you have that cannot be excluded under the law of your country of residence.
8. Limitation of liability
To the maximum extent permitted by law, the operator is not liable for indirect, incidental, special, or consequential damages, or for loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of Spark.
To the maximum extent permitted by law, our total liability to you for any and all claims relating to Spark is limited to the amount you paid us in the last 12 months (currently €0 for the free app).
Nothing in these terms limits liability for gross negligence, intent, or rights consumers have under mandatory law of their country of residence.
9. Governing law
These terms are governed by the law of Slovakia, where the operator is established.
If you are a consumer in the European Union, this choice of law does not take away the mandatory consumer protections of the country where you live — you keep the protections that the law of your home country guarantees you and that cannot be overridden by agreement.
Where the law gives you the right to do so, you may bring proceedings in the courts of the country where you live, and disputes will be heard in the courts of your country of residence where the law requires it.
10. Changes to these terms
This is version 1.0 of our terms, effective 29 July 2026.
From time to time we may update these terms. If we make material changes, we will announce them in the app before they take effect and update the effective date above. Your continued use of Spark after a change takes effect means you accept the updated terms. If you don't agree with a change, you can delete your account under Settings → Delete Account.
