Terms of Service for Spark Waitlist

2.1 Waitlist

The Spark waitlist allows you to express interest in the upcoming Spark application and, where available, receive early access or other promotional benefits.

Your position on the waitlist may depend on factors such as the time of your registration and the number of valid referrals associated with your account.

2.2 Referrals

When you join the waitlist, you may receive a unique referral link. You may share this link with others to invite them to join the waitlist.

A "referral" is counted only when:

• A real person joins the waitlist using your unique referral link;
• They provide a valid email address and do not unsubscribe or request deletion shortly after joining; and
• We do not detect any signs of fraud, abuse, bots, scripts, disposable or temporary email addresses, or other manipulation.

We reserve the right, in our sole discretion, to decide whether any referral is valid and to adjust referral counts at any time.

2.3 Rewards and Prizes

From time to time, we may offer rewards (for example, early access, lifetime Premium access, or other perks) to users who reach certain positions on the waitlist or achieve a certain number of valid referrals.

By participating, you acknowledge and agree that:

• All rewards, prize descriptions and thresholds are promotional in nature only and do not create any legal entitlement or guarantee.
• Rewards are subject to availability and may be changed, substituted, delayed or discontinued at any time, for any reason.
• The final decision on who qualifies for any reward or prize will always be made solely by Nikodem Zelenak, acting as the owner/operator of Spark, and that decision is final and binding.
• We may, at our sole discretion, delay, modify or cancel any reward, prize or the entire referral program if we believe it is being abused, is not technically feasible, or is no longer commercially reasonable.

2.4 Right to Cancel or Modify

We explicitly reserve the right, at any time and without liability to you:

• To cancel, suspend or modify the waitlist, referral program, rewards, prize structures or any related promotion;
• To correct any error in displayed rankings, referral counts or reward information;
• To disqualify any participant who we reasonably believe has violated these Terms, attempted to game the system, used automated tools, fake accounts or otherwise acted in bad faith.

2.5 No Cash Alternative

Unless we expressly state otherwise in writing, rewards and prizes:

• Have no cash value;
• Cannot be exchanged for money or other consideration; and
• Cannot be transferred, sold or assigned to any other person.

2.6 No Warranty for Rewards

Participation in the waitlist or referral program is voluntary and provided "as is" and "as available". We make no promises that any specific reward, prize, launch date or feature of the Spark app will be delivered, and we are not liable for any loss, disappointment or expectation you may experience in connection with the program.
